General conditions of sale 

Article 1: Scope of application

These general conditions of sale apply to all transactions concluded through the website, www.parentsplaybook.org. A "client" is any natural or legal person making an order validated via our secure payment platform. The “company” or "the Offices" refers to the Law Offices of Michelle Kotler, P.A., a Florida corporation.

Article 2: Order

Any order placed on a site belonging to the company implies full and unreserved acceptance of these general conditions of sale. The client is the age of majority and has the capacity to legally bind contracts.  The client is not placing this order for any illegal or unauthorized purpose, including, but not limited to, reprinting or transferring this material, using it to create a profit, taking ownership credit for the material, or for any other reason without the express written consent of the company.

Article 3: Price

The prices are indicated in U.S. Dollars, not including sales tax, if any.  The price of items can be changed at any time. However, the price applied to an order will be that announced at the time of the order.

Article 4: Payment

Payment is due immediately on the date of the order, including for pre-order products. You can pay by credit card such as Mastercard, Visa, American Express, or Discover. Secure online payment by credit card is made through the company Stripe. The information transmitted is encrypted by software in the rules of the art and cannot be read during transport over the network. Any guarantee as to the security of this system is entirely the responsibility of the company Stripe and cannot be attributed to us.

Article 5: Delivery

Delivery of digital goods is made to the e-mail address you specified when placing your order (therefore, pay particular attention to the spelling of the e-mail address you enter). You may access this digital item unless and until it is discontinued on its current hosting platform, Systeme.io.

Article 6: Protection of personal data

Your personal data will not be sold or shared by the Offices or by Michelle Kotler.  Your personal data is not stored except to the extent done by Systeme.io, which mainly applies to storing your email address for the purpose of ongoing communication.  Systeme.io's Privacy Policy can be found here:  https://usa-official.systeme.io/privacy

Article 7: Company information 

The Law Offices of Michelle Kotler, P.A. is a company incorporated under Florida law, the address of which is: 4303 79th St W.  Bradenton, FL 34209

Article 8: Changes to Terms and Conditions

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will make reasonable efforts to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.  By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, in whole or in part, please stop using the website and the Service.

Article 9: Returns and Refunds

Refunds are available only if you fully participate in the four-month program — including the complete curriculum and all weekly coaching calls — and honestly believe you did not learn anything new. In that unlikely event, we will refund every penny. (P.S. It hasn't happened yet!)

Article 10:  Disputes

Any disputes arising between the parties shall be interpreted according to the laws of the State of Florida. The parties agree to attempt to resolve their disputes informally first, then by mediation, and then by arbitration. Each party shall bear half the cost of mediation or arbitration. Neither the Offices nor Michelle Kotler personally shall be liable for the other party's costs of mediation or arbitration. Arbitration results shall be binding, but at no time shall the Offices or Michelle Kotler personally be liable for more than the cost of the course(s) purchased. Neither the Offices nor Michelle Kotler personally, her employees, contractors, heirs, or assigns will be liable for any compensatory, punitive, or consequential damages asserted as a result of the purchase of these digital products.

Article 11:  Reproduction

You agree not to reproduce or share, or attempt to reproduce or share, any contents of the “Parents' Playbook for Special Education Success,” including electronic, printed, photographic, audio, and/or video material, with any third party, whether the material is copyrighted or not. This restriction applies whether or not the content is being shared for profit. You may not claim any of the contents as your own work product.

Article 12:  Disclaimer

Purchasing this course does not create an attorney-client relationship. Specific legal questions will not be answered and the firm will not render individual legal advice to purchasers. The information shared is general information and is not specific legal advice for any particular situation, nor is any of my content a substitute for legal representation or advice.  

This course is designed to educate parents in the basics of the Individuals with Disabilities Education Act ("IDEA") so they can help their children as quickly as possible. It does not teach you every single aspect of the IDEA, or all substantive or procedural legal knowledge in general, either federally or in your State.

The IDEA permits school systems to sue parents who bring frivolous or unreasonable due process hearings to recover the school system's legal fees. While this is rare, it can happen. A frivolous lawsuit is a legal action that lacks merit and is brought for an improper purpose such as to harass, delay, or extract a settlement from the defendant. It's essentially a lawsuit with no real basis in law or fact.

Using the course materials is not a guarantee of a successful outcome. No attorney can guarantee a result in any matter, and an online course certainly cannot do so.  There is no express or implied Warranty of Merchantability or Warranty of Fitness for a Particular Purpose. The Law Offices of Michelle Kotler, P.A., Michelle Kotler personally, her employees, contractors, heirs, or assigns are not liable for outcomes or results subsequent to purchasing the “Parents Playbook for Special Education Success.”

Timelines apply to any legal matter. You may want to seek legal representation if you feel you have grounds for a legal action in order to avoid your complaint being barred by any statute of limitations.

You will have to do additional legal research independently if you pursue a due process hearing. Federal and State statutes and regulations are quite lengthy and complex. Case law, statutes, regulations, and policies change over time. This course is not a substitute for conducting legal research or a legal research tool.

Any resources shared are a starting point and are not intended to be fully comprehensive. You must check that any relevant court cases have not been overturned on appeal, & that U.S. Supreme Court decisions cited when the course was developed have not been changed by a more recent U.S. Supreme Court case. 

Article 13:  Waiver & Release

You consent for the "Parents' Playbook for Special Education Success" to reproduce your photographic image, and/or your written, audio, and/or video comments and feedback about the course on its website and/or in social media for marketing and promotional purposes. You hold harmless the Offices, Michelle Kotler personally, her employees, contractors, heirs, and assigns for doing the same, as well as for any outcomes you may experience after purchasing this course.

Article 14: Acknowledgment

You acknowledge that purchasing the “Parents' Playbook for Special Education Success” or any other materials developed by the Law Offices of Michelle Kotler, P.A. means you have read and understood these Terms and Conditions and you agree to be bound by them.
